Agreement to Terms
By using the services of the Cal Poly Pomona Office of Conflict Resolution Services and Ombuds ("the Office"), you agree to be bound by these Terms of Use. These Terms of Use are subject to change as outlined in the Ombuds Charter.
Confidentiality Protections
Conversations with the Ombuds and Office staff are confidential to the greatest extent possible under federal and state law and applicable CSU Policies and Regulations. However, the Office cannot keep confidential information that suggests imminent risk of harm to individuals or public safety, child abuse and neglect, or incidents of sex discrimination, sexual harassment, sexual misconduct, dating or domestic violence, and stalking.
Non-Recording of Conversations
Users of Ombuds services will not record conversations with the Office and that recording without Ombuds consent violates CSU policy and is illegal in California. The Ombuds Office is not required to maintain confidentiality regarding use of Ombuds services if a user records Office staff without explicit consent.
No Compelled Disclosure
Users of Ombuds services will not seek to require the Ombuds or staff to disclose confidential information shared with the Office in any other setting, including internal investigations, legal proceedings, or administrative hearings nor will the University do so unless required by law or CSU policies and regulations. Neither users of Ombuds services nor any CSU employees may waive confidentiality of communications without the Ombuds’ permission—except when disclosure is required by a court order or CSU policies and regulations.
Voluntary Use of Services
Use of services is entirely voluntary. No one may require a person to use Office services. Individuals have the right to manage their own issues and outcomes without judgment or restriction by the Office. Use of services will not limit the availability of or access to any other remedies or processes.
Informality of Services
The Ombuds Office does not make formal findings, enforce agreements, conduct investigations, or order remedies. The Ombuds Office will also not take action on an individual’s or organization’s behalf unless the Ombuds explicitly agrees to do so.
